What if a debtor is contacted by a creditor after filing chapter 13?

All of a debtor’s creditors listed on the chapter 13 petition are under an automatic restraining order that prohibits them from contacting the debtor in any way. If a debtor receives notices in the mail from a creditor, the notices should be forwarded to the debtor’s attorney. If a creditor attempts more personal and direct contact with the debtor (e.g. telephone call, a summons, personal letter, or visit in person), then the debtor should immediately inform the them that they are under chapter 13 and give them the case number, and the attorney’s name and address. The debtor should not discuss the debt with the creditor under any circumstances.
